2018 Taste of Home Gingerbread Boulevard Giveaway (#452) Official Rules

The 2018 Taste of Home Gingerbread Boulevard Giveaway (#452) (the “Sweepstakes”) is sponsored by RDA Enthusiast Brands, LLC (“Sponsor”). This promotion begins at 10:00am (Eastern time) on November 26, 2018 and ends at 11:59pm (Eastern time) on December 11, 2018 (the “Promotion Deadline Date”).

1. ELIGIBILITY: Sweepstakes open to legal residents of the United States, its territories and possessions, who are 21 years of age or older at the time of entry. Employees, officers, directors and agents of Sponsor, The J.M. Smucker Company and/or any of their affiliated or subsidiary companies, judging agents and promotion partners (collectively, the “Promotion Entities”), and immediate family members and members of the same household (whether related or not) of any such employees, officers, directors or agents, are not eligible to participate in this Sweepstakes. Sweepstakes is void where prohibited by law. Subject to paragraph 6, all applicable federal, state and local laws and regulations apply.  

2. HOW TO ENTER: You can enter this Sweepstakes in person at Sponsor’s Gingerbread Boulevard display site or via the Internet. To enter in person, please visit Sponsor’s Gingerbread Boulevard display site located in Madison Square Park in New York, New York from Thursday, December 6, 2018 to Tuesday, December 11, 2018 (noon-6:00pm Eastern time daily) and follow the instructions at the kiosk. To enter online, go to https://www.tasteofhome.com/GBBlvd during the period beginning at 10:00am (Eastern time) on November 26, 2018 and ending at 11:59pm (Eastern time) on December 11, 2018 and follow the online entry instructions. There is a limit of one entry per person. If multiple entries are received, only the first entry will be included and later entries will be disqualified. All entries become the property of the Sponsor and will not be returned. Each entry has an equal chance to win. In the event of any dispute regarding the identity of an entrant who submitted an online entry, the authorized account holder of the email address used for the entry at the time of entry will be deemed the entrant. “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g. business, educational institute) that is responsible for assigning email addresses for the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry. In the event this Sweepstakes is entered via a mobile device, Message and Data charges may apply. Sponsor is the official timekeeper for this Sweepstakes and, in its sole discretion, reserves the right to disqualify any person tampering with the operation of the website or the entry process.

3. PRIZES: Twenty prizes will be awarded as follows: each prize consists of brunch or dessert at Gingerbread Boulevard for the winner and 2-3 guests at a designated time, as determined by Sponsor in its sole judgment, on any of the following dates: December 15, 2018, December 16, 2018 or December 18, 2018 (dates are subject to change). The approximate retail value (ARV) of each prize is $250. The total ARV of all prizes offered in this Sweepstakes is $5,000. Travel is not included; winners and their guests are responsible for their own travel arrangements. Each prize is not transferable and cannot be redeemed for cash or substituted or assigned by the winner, unless prohibited by law. Sponsor may substitute a different prize of equal or similar value. Prizes are subject to delay, postponement, change of location, or cancellation in the event of inclement weather, lack of access to the display site, or for any other reason beyond the control of Sponsor. The Promotion Entities, the prize provider(s), and their respective employees, officers or directors, will bear no responsibility for any loss, liability or damage arising out of the acceptance or use of the prize by any winner or their guests. Redemption of prize is subject to the terms, conditions and policies of the venue where the display site is located. All taxes, if any, are the sole responsibility of each winner.

4. WINNER SELECTION: Winners will be selected by random drawing from all eligible entries on or about December 12, 2018 by Sponsor, whose decisions are final in all respects. Odds of winning depend on the number of eligible entries received. Approximate odds of winning are estimated at 1:10,000. Each winner will be notified by telephone and/or email following the drawing with the date and time for the prize and other details for prize redemption. Within 24 hours of prize notification attempt, each winner is required to confirm their acceptance of the prize and the availability at the designated date and time of the winner and their guests, or they will be disqualified and prize may be awarded to an alternate winner. Return of prize notification as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of any prize constitutes permission for the Sponsor and its agencies to use the name, address (city and state) and/or likeness of the winner and their guests for advertising and trade purposes without further compensation or authorization, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, unless prohibited by law. Sponsor may require winners and their guests to execute releases and confirmations of the foregoing rights.

5. CONDITIONS: By entering, participants agree to be bound by these complete Official Rules and Sponsor’s Privacy Policy, accessible at www.tmbi.com/privacy-policy. The Promotion Entities are not liable for, late, lost, delayed, damaged, misdirected, incomplete, garbled or jumbled, stolen, postage due mail or illegible entries or for printing, distribution or production errors. The Promotion Entities are not liable for any malfunctions or failures of any telephone network or lines, computer internet system, servers or providers, computer equipment, software, failure of any email on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer, mobile or any other device and/or its contents related to or resulting from participation or downloading any materials relating to this Sweepstakes, or other technical difficulties or failures or other errors of any kind. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for any prize and may be prosecuted to the full extent of the law. Sponsor reserves the right to terminate or modify the Sweepstakes at any time for any reason. In such circumstances, prizes will be awarded based on entries received to date of termination.

6. NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES/SEVERABILITY: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Sweepstakes are hereby excluded, and any entrant expressly waives any and all such rights. In the event that a court of competent jurisdiction finds the foregoing waiver unenforceable, entrants hereby consent to the jurisdiction and venue residing exclusively within the federal or state courts sitting in Westchester County in the State of New York, U.S.A. and agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action. Entrants agree that these Official Rules are governed by the laws of the State of New York, U.S.A. without reference to principles of conflicts of law. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
